It's harder than you think. computers easily mistake shadows in certain areas as facial features after a certain darkness of skin. Correcting the issue generally would require a ton of R&D. it's a basic white value issue with cameras generally. The balance needed to correctly record a well lit room naturally over darkens darker skin tones. The issue with just changing the white balance is that certain features are regularly lost by the washout. An algorithm may be able to correct it enough for photography, but the flawed nature means there's no way it should be admissible as evidence in a court of law. No, switching to infrared wouldn't work, as it would just washout more people. Plates are rather strictly standardized, faces are much too variable and can change without turning away from the camera
