It's easy. Only train generative ai on material that is consensually given, then it won't be theft. Problem is people don't want to wait for consent or to even to bother asking for it, so we're likely past the point of that even being feasible.
And even then, ai generated images will only ever be content. They will never be art. At least not until we reach some sci-fi point in the future where computers can actually, genuinely think for themselves.
