@justfreakingrob AI does not function as the human mind does. Also, humans do not process data, nor do they reproduce it with 100% fidelity in any performance even when they memorize the material and practice for years in efforts to do so.
No one is trying to prove that "AI is no more of a threat to human artists than other human artists". In fact, the claim is just the opposite--AI is a threat to human artists.
AI generated content deprives human creators of revenue both by using valuable copyrighted works as training data without paying a license fee and by churning out tens of thousands of works daily, thereby diminishing the market for the works of human authors.
Litigation is about convincing a judge or jury that a violation of law has occurred. In the case of Thomson Reuters v. ROSS Intelligence, Judge Stephanos Bibas held that a market exists for copyrighted works as training data.
Therefore, ROSS violated the copyright of Thomson Reuters by using the headnotes taken from Westlaw as training data without negotiating a license (though ROSS did attempt to acquire such a license, but Thomson Reuters refused to negotiate because the AI being developed by ROSS would have competed with Westlaw).
