If you can't copyright it no one would be able to sue you for it. The only way it would look the same as something else is if you give it a reference of an already existing image. I think the only way you're going to get sued is if they make it illegal to sell images that are generated from a dataset that has copyrighted images.
I use some of these generative AIs but I use them for ideas and concept art, I also gave the images to an artist as references for one particular design.
