I don't really understand the copyright infringement angle. References of art are used all the time by artists and that's what AI image generators do, it's not really stealing anything. It's like saying fan art and OCs in a certain style shouldn't be allowed to either. It feels like it's more of an ego issue more than using one's art for reference.
Now, people using and/or claiming a piece of art came from a specific artist, *that* I feel is a valid complaint, as well as companies using it as a replacement for actual human artists.
I don't think "photos" should be allowed to be simulated, though, for the reasons you mentioned.
