Art is the intentional creation or performance, through human (or agent) creativity, imagination, and skill of objects, experiences, arrangements, or actions primarily intended to evoke or afford aesthetic, emotional, intellectual, or expressive appreciation and engagement.
AI prompting exists on a spectrum. At one end of it, basically commissioning a super-fast, infinitely revisable 'artist.' You describe what you want, it executes with its own flair. At the other of it, with detailed control, iteration, and post-editing, it functions more like an advanced tool you actively direct, where your vision and refinements make you the primary creative force. Prompt engineering can be real labor intensive spending hours refining descriptors, and testing compositions. But it's not the same as manually drawing. I’m in the middle of this AI debate because both extremes are true depending on how people use it, and the best results often blend AI speed with human craft/heart.
This is actually kinda a win for art in general whether AI or human. The current copyright system has problems that encourage some bad business practices. The current copyright system, particularly in the US and EU, is ill-suited for long-term societal needs, favoring short-term commercial interests over cultural access, innovation, and sustainability; extended terms like life-plus-70 years or 95-120 for corporate works, driven by extensions such as the 1998 Sonny Bono Act, stifle the public domain by delaying free use for remixing, education, and preservation, despite evidence that most revenue accrues early and shorter original terms (e.g., life-plus-14-28 years) better balance incentives. In the digital and AI era, it falters by enabling over-blocking via automated takedowns under laws like the DMCA, chilling free speech and fair use, while creating uncertainty for AI training and outputs that often lack protection, potentially hindering scientific progress. Furthermore, it conflicts with environmental goals by restricting upcycling, repairs, and circular economies through moral rights and protections that prioritize exclusivity over reuse in a climate crisis. Reforms such as shorter durations, enhanced digital fair use, and AI exceptions could realign it with its historical aim of promoting progress.
