It is not illegal to cross mid-block in AZ. Yes, the pedestrian must yield the right of way to vehicles when not in a crosswalk, but failure to yield should result in a death sentence. The video released of the victim is highly suspect, as it shows the victim only visible in the vehicle's headlights at a very close distance. That would not be reasonable, and is not likely what the onboard AI "sees" when processed. Makes me think the video was doctored to make the shadows darker than reality. In any event, the Uber car's sensors should be able sense the pedestrian in the dark. Many of us living in urban conditions have witnessed street/homeless crossing mid block, especially at night. I've always been able to see them with the naked eye, even under poor lighting, and avoid impact. Most urban planners (Strong Towns, etc) today are appalled by the idea of self-driving cars in the urban/city environment - for reasons of social justice. We already have a caste system, with pedestrians and bicyclists at the bottom. Self-driving cars further this caste system. I for one, do not want to live in a world that worships cars to that extent. The idea of placing AV sensor "beacons" on pedestrians and bicyclists would be impractically funny, if it was not such a sad statement to suggest. Forget your beacon, or it fails, and the result is a death sentence? Big take away (besides Uber's tech failed miserably), is that law enforcement is completely unprepared to investigate and evaluate self-driving car crashes. Current laws on the books do not provide adequate guidance on whom is at fault. It is not so simple that the victim is at fault due to fail to yield. Drivers have a legal duty to be alert and avoid a crash. I expect Uber's attorneys will move heaven and earth to settle with the victim's family quickly and have them sign a non-dosicloure agreement - so they can bury the facts of this case. Self-driving cars are testing in AZ because of lax laws on public disclosure of test fails and crashes.
