I've actually researched GANs (which is often the underlying structure of how the AI algorithms learn to draw) (but in no way an expert) and while neural nets do have a habit of trying to copy the input data set, half of the GAN system is designed to prevent that. However I do agree that they shouldn't be able to legally profit off of models trained with other people copyrighted data.
One major reason why audio can use public sources is because sound is actually considered a lower dimension than images and its magnitudes easier to train. Which means you need a lot less training data. Still doesn't justify them stealing work.
