Parsing the 5 C’s that David Sacks lays out, four of them don’t require federal preemption at all:
– Child safety stays local,
– Communities control infrastructure,
– Creators are already federal under copyright,
– Competitiveness isn’t determined by state zoning or speech rules.
The only area where state law would directly conflict with AI deployment is compelled viewpoint regulation — which is narrower and more specific than “censorship” in the usual sense.
For example, a state could define “algorithmic discrimination” so broadly that a model is legally required to generate certain outputs or phrase things in a particular way to avoid liability. That isn’t classic suppression; it’s compelling speech to conform to a legally preferred interpretation.
And here’s the key point: solving that compelled-speech issue would not alter any of the other C’s. It has zero impact on child protections, local autonomy, copyright structure, or America’s competitive position. So this is a single technical policy concern, not a justification for treating the whole AI ecosystem as if all five C’s depend on federal preemption.
