Split fiction is making a completely different point though. And I am not even talking about the company trying to take the ideas that weren't released, which AI can't do, but that there is a difference between training an AI and the output. You equated the training of an AI with Humans being Inspired by other Art, but the real comparison is the AI training and a human learning how to draw. The style and techniques an artist uses is copied off of other art that is copyright protected but no one cares about artists stealing that from other Artists. Originality doesn't exist, everything you do regardless of how wild and fantastical it might be is just a remix of things you have already seen. Where you are correct is that the AI doesn't have intent, unlike humans, but then again, the Intent when drawing doesn't change the fact that before drawing, while learning both the AI and the Artist use copyrighted work to train themselves to be able to draw. Humans are just a lot better at hiding it and take in a more varied sampling size, since the AI isn't taught how to draw something like let's say Gundams by looking at everyday life pictures it only sees robots as training. The easiest way to check the validity of arguments would be to put them into their logical extremes. Would a sentient AI still be stealing art if it had intent behind the things it drew? Would Artists put down their brushes and concede defeat and give their jobs to the AI if the AI was advanced enough? If not, then the argument against AI is actually just a excuse to fight against something that is threatening your livelihood, something Artist didn't really care about when jobs were moved abroad or given to robots. The other extreme would be if you had a human that is only capable of looking at things and drawing exactly what they saw or a mixture between what they saw, no own thought put into it, would that person be stealing copyrighted art and should be stopped? I personally believe it's the fear of losing ones jobs, which, or at least making it harder to compete for jobs which is a valid fear. I also think there's a bit of jealousy in it, since years of work and dedication is being usurped by some nerds that wrote some code that can copy all that hard work in a few days and will most likely get better and better for less and less money.
