Here's the problem: if they weren't charging for access, open AI would reasonably be able to argue it's the exact same thing as having a person with a provably edetic memory, call to mind a Time article that they have read and verbatim recite the article from memory, and you can't sue specially abled people because of their special abilities.. BUT.. you can't profit off of copyrighted materials belonging to someone else.. so arguably ok for a free to everyone service, AI or otherwise, but legally unacceptable for a company that is charging a fee for that...
