AI generated art isn't supposed to duplicate existing works. If that happens, the AI company is doing it wrong. I stand with the second argument that machine learning is no different from an artist being influenced by and taking inspiration from other artists.
Add: I forgot about the option to base the art on another work. If the user chooses a strong correlation, the artwork comes out similar and they sell it, that's a copyright violation. If the law doesn't reflect that, I hope it'll be amended to protect artists.
