He didn't say anything about marriage. If it was illegal before, and making it illegal was removed, it is now legal. I don't know why you think legalization has to mean marriage. EDIT: Yes I know unions ("recognized by the law")are marriage are not exactly the same thing. They are usually close enough for my point to stand.
