There are many AI image generators that don't disclose their trained datasets. Therefore, artists can not even know if their work was used or scrapped from their portfolio sites. With AI like Stable Diffusion, you can search the LAION dataset to see if they are using their work, but they don't actually include the images (just links), so it falls into a gray area. This is why the Concept Art Association is crowdfunding for lobbyists to bring this issue to the attention of lawmakers. A court case could determine if images can be scrapped without consent, and if machine learning image generation falls under Fair Use. (Which in my opinion, it doesn't.)
