Having read the article in the pinned comment, it seems the argument in that particular case, is that the AI model is "unlawfully storing compressed copies" of the artwork it's scraped. However, by definition, when you use Google image search, to search for a particular artist's work...the simple action of Google producing thumbs of the works is also storing compressed copies of the works to your device. Which by definition of this case, should also then be considered unlawful.
