I'm not sure about the legal path AI will take from now on (though considering the very recent Disney and Universal joint lawsuit that between your comment and my response, we might have an idea for the near future...), but there's still a fundamental difference between AI and other technologies of the past in that AI *emulates* past technologies whereas said technologies didn't do that back then (and even, the backlash against photography in the 1800's is either exaggerated or oversimplified by modern narrative).
