Your are right that the goal of the copyright legislation being driven by the desire to incentivize art creation and innovation. For this reason artists are guaranteed property rights for their original works for a period of time. There are two problems with the current AI created art.
1. It violates the mentioned above property rights of the artists whose works were used to train the AI models.
2. It contradicts the entire goal of the legislation because AI art generation doesn't incentivize creation and innovation. AI is limited by the human created art it's trained on and it disincentivizes creation of art by humans by flooding the market.
In the long run it is crutial for AI companies to have a source training data for art creation, as well as for the society to have a source of creativity and innovation that AI can not provide for the reason mentioned above. Therefore, the AI companies have to respect the copyright laws and ask for permission or compensate artists for their works.
Also, people voting with their wallet argument doesn't really support or contradict the copyright argument. If people prefere AI created art made by a company that doesn't violate the copyright laws then so be it.
