It will probably depend on how they make their arguments in court. Since there is no safe guard, NYT will probably use that as leverage to claim that because there is so many users and people use them for summaries, then OpenAI most likely committed copyright infringement by recreating their articles just on probability alone. And that is certainly a valid concern and argument. The real question is, does the copyright claim hold water if they did make an attempt to avoid allowing it to recreate copyrighted material? In which case, their argument about prompt hacking might hold water. It would be kinda like you asking someone to paraphrase the same article over and over until you've basically got enough of the original material from them you can accuse them of copyright. Just done at the speed of modern computing.
