@tobyandahalfno. They are not. Because transformative use is fair use. You know all those “reaction” videos you have watched on YouTube over the years? The one where a YouTube “takes” content from someone else and then runs their mouth giving their opinion? Do you think that they “got permission” from those original creators? A new episode of your favorite show comes out and someone is offering hot takes…complete with snippets of the original program. Did they “get consent” to use that? Of course not. Were they “stealing”? Of course not. Because even you know that that’s fair use…and even you know that fair use isn’t stealing. But let me guess. You’ll follow up with some version of “But that’s different!” and then offer up some reason why you think it’s a special case. It isn’t different. The only difference is that you like certain things. And the thing you like where someone “takes” and “uses” without consent…it’s okay because it’s fair use. But if you DON’T like it…then like magic…fair use just…vanishes into thin air. Transformative use is fair use and fair use by definition is NOT stealing. And has there ever been something more transformative than having a computer “look at” a couple billion images and then come up with a ball of math called an”ai model”? No. I think not. It is the most transformative thing we have ever done.
