@AZAEL-music I am not missing that point at all. It is impossible to compensate all of the artists whose work has been used for training data. There are far too many of them and there would be no way to track who's work specifically contributed to which art being generated, as it has essentially all been thrown in a blender. Copyright/Trademark does not apply to an art style, only to specific works or specific characters and their reproduction. Characters/works can be similar to but must be legally distinct from characters with an active copyright or trademark. You only have a case if you use AI to recreate an actively copyrighted character or work and use that for profit or distribute it in a way that could be considered as harmful to the profits of the copyright/trademark holder. This is a bit of slippery slope, however, as all fan art that depicts copyrighted or trademarked characters is technically a legal violation. it is just not financially viable, and has bad optics, to sue every rando on the internet posting fan art, and it is typically best to chalk it up to appreciation and free advertising rather than litigate these cases. Most artists that are mad about their work being used for training data likely don't have a leg to stand on because their characters/works are probably not being exactly replicated due to lack of notoriety, and if they were to sue, they would need to sue whoever used AI to replicate their work and then distributed it. If an artist worked for a corporation, they don't likely hold a copyright or trademark for their work anyway, the company does, which means it is the company that owns the IP and has legal grounds to claim damages, not the artists who are having their jobs replaced. AI was trained on artwork, not to steal it or to exactly reproduce it, but to generate new works with what was learned. AI is capable of reproducing works or characters in a fashion that violates copyright or trademark, but so is a human artist who learned from/trained on it, even if it is simply by having witnessed it. One cannot sue a tool or the tool's creator because someone misused it. The person who violated copyright or trademark would be the person doing the prompting and or distribution. Further, no artist's work has been "stolen" if it is out in the public sphere to be observed, it is equally available to any human artist who looks at it to learn from it and gain from it as it is to AI. Again, this is a case of people being mad that AI is doing exactly what humans do, learning from the work of others, just doing it way better than your average human can. They are also mad about accessibility making their skills less desirable. This is understandable. As I said before, there is no putting this genie back in the bottle. Opensource AI art generators are out in the wild and they will forever remain so, no matter how much legislation gets passed. These are too valuable to the people, there will always be someone distributing them, even if it is via piracy and black markets. You can also be guaranteed that the big corporations would be secretly using them in-house, or ensuring they can legally use them in-house, while trying to ban them for the average user. You would need an Orwellian big brother system to track down all the AI's on everyone's computers and delete them to be rid of it. The only way forward is to become AI literate so that "true artists" can have their art skills as a value-added proposition on top of their AI skills, as compared to non-artists who can only prompt AI. The industry isn't going away, it is being streamlined. Corporations need fewer artists to get the same job done with AI, they don't have a lack of need for artists at all. The only way to remain viable, the best way to retain or get a job in art, is to be an AI literate artist. Also, being AI literate as an artist means that if you work independently, for example, doing commissions or patreon, you can enhance your productivity in your personal workflow in the same way that the big corporations are. So, no matter who you are, you should be getting onboard with AI. Railing against it is screaming into the wind. Turn around, throw up your sail, and catch the wind and do your best to ride it to productivity, otherwise you'll just get blown away and left behind by everyone else who saw the inevitability and did the smart thing.
