I think it's more likely that the law will end up treating AI models like Xerox machines. In that, Xerox isn't responsible for how their devices are used. If someone copies a book with a Xerox machine (and that person then distributes it), it's that person who violated the author's copyright—not Xerox. Disney's lawsuit amounts to, "People can use your tool to generate images that are similar to our copyrighted works." The defense should respond to that with, "Yeah, so? Go after those people, then!" Another thing that's important is that copyright is all about distribution: Until a work is actually distributed (copied, given, sold, etc), copyright law doesn't realistically apply (not in the US, at least). Disney will have to make the argument that Midjourney isn't just a service provider under the DMCA (which would protect Midjourney under the Safe Harbor clause). To make that argument, though, they would need to prove that Midjourney is willfully violating their copyrights (by creating and distributing derivative works). However, that is unlikely to sway a judge since image models are highly transformative. At the heart of every image generator or LLM is a random number generator.
