A couple of things... firstly, I'd suggest that most peoples definition of "art" is that the artist themselves were responsible for 100% of what you see, that the work is hand-crafted. When people look at art, there is the expectation that the artist was responsible for 100% of what is on show through their own hands and ideas. AI art, at any %, isn't that - a computer is responsible for part of it.
This is about honesty, and so called "artists" who are deliberately misleading buyers. If there were no thought that AI art is lesser, then no-one would care. But they do! It seems to me that those who use AI know this full well, and then actively attempt to "hide" the truth. If not, why don't they mention AI in their booth?
Secondly - while your idea might have merit in a perfect world, we always have to ask ourselves whether something is police-able or not. It's bad enough having to figure out whether something has AI elements or not, let alone the % of AI used. It's not reasonable to suggest there is a threshold at which it's okay.
Crooks will always try to trick people into handing over cash. Dishonest people will always be trying to find a method to rob people. It's sad, but is the way of the world. Conventions need to do a better job in policing this.
