You're absolutely crazy if you think the New York Times has been using AI to write articles for it's decades of publishing millions of words each year. This lawsuit is only a few months younger than ChatGPT in the first place. The reason it could be prompted to reproduce articles is because newspapers have a style, and venerable papers like the NYT is a large chunk of it's training data, as it contains a lot of reliable reporting across diverse topics.
Also, "verbatim" isn't relevant to copyright. If, when prompted, ChatGPT reproduces "only" 90% of the same words as an article, that's still plagiarism even though some of the words are changed a little, and it's legally still copyright infringement so long as the "heart" remains the same.
"Physically" storing an exact copy isn't relevant for copyright. Publishing an indistinguishable substitute is.
