All visual works created are copyrighted from inception. But one cannot copyright a style, thankfully.
Imagine not being able to do any more stylized works because Disney owns the copyright to the toon style, it would be the death of art as we know it.
Any human, whether or not AI is used, who recreates a piece and uses it commercially, is doing something illegal. This has nothing to do with AI.
AI is the tool. Having it learn a style and creating original works within that style is no more illegal than if I, as an artist, decided to do the same manually (which I am perfectly able to do)
This isn't a copyright issue. This is an existential issue. Artists are one of the first affected by AI... But surely not the last. So many are turning into luddites.
I for one am adapting to leverage the tools completely.
