I see what you're saying Anton but we aren't dealing with people we are dealing with an ai which had to be fed unethical data from living authors. The fact is that when I human learns to draw we dont require the original piece to make derivatives of the work (we can just look at it) however with an ai the original work must be inputted into the model at somepoint.
I would like to clarify there is not a credible source that will say an ai and a human learn how to construct images in a simar way.
Also you know that its been proven that while these models make a large amount of seemingly new images they are prone to overfitting.
