Which AI doesn't do.
There's no "transformation" happening. It's not creating a new work - summarizing could be considered transformative IF it didn't include vast quantities of verbatim quotes.
AI is doing the equivalent of outputting "I think..." followed by reproducing Hamlet and claiming it's a new work.
But kore importantly, as several other cases have ruled, AI CANNOT BE TRANSFORMATIVE. It's a machine and cannot, by itself, produce copyrighted work. E.g. paintings by AI are unprotectable.
If it can't produce a copyrightable work then it cannot be transformative, as thr latter is ONLY a feature of the former.
Ipso facto it's pirating.
