No, it's tesla's fault for letting him continue to use the automatic driving features when he'd already been locked out of them already that night, and also for continuing to keep them engaged when he was manually controlling the accelerator. The second you get locked out, it should stay locked out and not just re-engaged with a shifting of the gearshift from drive to park to drive. Also the SECOND you touch ANYTHING controlling the vehicle, auto-driving is disabled. Stupider systems like cruise control do this for a reason. Oh and one final bit, the BREAKS should override the accelerator in any and all circumstances. If the car couldn't break because his foot was on the accelerator, that's a design problem and on Tesla.
