While face recognition software should be illegal, I think there are so many more reasons why a camera would not pick up a darker skin beyond bias in the dataset. Let's remember there are cameras involved in the face recognition process, and this implies that the image input is greatly influenced by light conditions on the surface to recognize anything at all.
Same reason why black and white actors are not lit the same way in Cinema.....
