I've been at the butt-end of the "art on the internet is not copyright" argument. That's silly. I'd really like to see someone take Elsa from Frozen and make a commercial movie around it. A.I. for concept art is the exact same thing. The law is murky where money is involved unless the adversely affected also have loads of money. The only way I see this going legit is a massive class-action lawsuit in the high Billions of dollars. Each art piece in the datasets is one infraction... each infraction is a fine up to hundreds of thousands of dollars... every time the dataset is used... every time the A.I. is used. They would have to destroy the A.I. and retrain another with artist consent or public domain images.
