I would say it is not fair use. It directly harms the original work's market (as why go to the paper if the AI spits out our articles, or even summarizes them) and it is not being used for non-commercial purposes. OpenAI is effectively scraping and reselling content without permission. If they want to train their AI, they have a litany of articles and publications available in the public domain they could have used instead, but opted not to. Linking is fine, summarizing or quoting verbatim is not. That's even before we get into the facts that schools typically require educational subscriptions to use newspapers, that newpapers would be harmed as they engage in legitimate sharing (via the associated press/Reuters) and implicit access via either subscription or ads is being ignored.
