My problem with the tool argument is that when a tool creates an object whole cloth, the human that prompted the machine to make something is not the creator. The tool/ process is. So when you prompt Midjourney to make something, Midjourney is the creator. The human can ask it to make something, and be very specific with the request, but they do not construct the image. The process is exactly the same as commissioning (prompting) a human, the human is just slower.
