Fan-Art selling is technically not legal, and some cons forbid it, especially if they have nsfw-areas, because some companies are litigious (see nintendo). But with smaller IPs or simply more customer-friendly companies, they usually do not care or consider it free advertisements. But its a case to case thing really. You mention the batman picture in background screaming AI and I think its because of the inconsistencies within the picture (I am a layman, but here are my thoughts): Having a cigar fits none of Batmans stereotypes (its actually the first time I see him smoking ever and I believe that is why you have this contextual dissonance that you feel "it screams AI"), you have this weird colour at the bottom with the cut-off letters. The white background looks weirdly unfitting because again, its batman. It should be something dark, gloomy or so. And I think its also in the context of the pictures around it, all of which seem to be made by another artist, as the style is extremely inconsistent. I was not at dragoncon but if somebody had shown me 3 random pictures of those and told me they are from the same artist, I would have told them bullshit. With artists not being present at a con where they sell stuff, I know at least one artist that is not. Firstly, because that artist is in the UK, selling art within the EU, where i live, is a bureaucratic nightmare. Secondly, that person is extremely introverted. So they have an agent, living in the EU, working for them and selling their art. But that is honestly an exception to the rule. Most artist I know take great pride in their hard work and want to sell it themselves. Fuck AI.
