The truth of the matter is that AI Art is here to stay and progress, the genie is out of the bottle.
For DevianArt it is a war of time, who will have the better and accessible AI for online art. Think of it of the startups of proto Netflix vs Blockbuster.
The legality of the "by default" vs "opt in" is debatable, look up GDP consent: some are opt in some are opt out, some are a hell to navigate with opt in the easy one button option so a lot of corporate legalise to wriggle out of it.
