For once, we might actually appreciate the NYT's paywalls. Because that's what they're mad about: money.
If ChatGPT can recreate NYT articles with enough accuracy, even copying them, then *yes* obviously they scraped the articles to train the bot. But the question, and allegation, is OpenAI didn't pay for all of those articles. And, moreover, it becomes a matter of potential loss of revenue (something courts love to take into account) given that users can just ask ChatGPT to recreate this article they read the headline of but do not wish to pay for.
And the fact that OpenAI tried to dismiss the lawsuit so quickly, and not settle early, really suggests they know they're losing this one.
