There are billions and billions of USD going into the training of Generative AI models - so it isn’t that these companies can’t access the funds necessary to purchase licenses for copyrighted art. The ‘fair use’ argument shouldn’t stand because the models regurgitate the pictures they are trained on. I hope that there is a strong win in court for some high-profile artists that sets precedents that mean the companies have to go back to the start and retrain their models only on art that is either out of copyright or which they have bought a license for. It would also be good to see a win in court that makes them redo their models without NSFW inputs (including the illegal stuff) - the models can’t produce what they aren’t trained on, so it isn’t a ‘mistake’ that these models can produce this stuff.
