The problem with AI art is that it is simple enough in concept for any programmer to grasp, and the code to do it has been made easier thanks to years of hard work and simplification from previous devs. Moreover, there are more innovations being done to AI imaging especially through RNN, CNN etc. This was necessary because the AI used in these "AI art" is the fundamentally the same AI that is used for medical disease treatment, Scheduling and Physics Simulation. Trying to "outlaw" this is physically, practically and financially impossible. It just cannot be done. And even if you somehow did, you'll end up killing hundreds of people, and setbacking decades worth of medical and scientific research. The AI that is used to predict blood clot stages, traffic prediction through imaging can be used to create AI art. All that is needed is a change in datasets and some tweaks as how it reads and outputs the images. Remove the dataset? That means artist cannot post or showcase their art online. Moreover, AI is quite literally based off of a human neuron. Its how these neurons, or "nodes" are connected and what augmented data it reads decides what the AI does. And as more and more artists post their stuff online, the better the AI gets. Its a losing battle through and through. Court can't do shit because the law itself is unenforceable on this kind of thing, not to mention the lack of precedence.
