The model once trained does not contain a single image, that would be impossible (laion 5b is 240TB). It would also be illegal, as that would require making a copy... Secondly, diffusion relies on finding images within random gaussian noise. For this reason it is literally impossible for one of these models to NOT create a unique original image each time. So the statement "ai takes data directly from that data set and it's able to make a perfect replica", that is fundamentally not true. Please look into how diffusion models actually work. Will there be changes to copyright law to prevent base models being trained on copyrighted images? Maybe... But I wouldn't bet the farm on it. Will copyright law continue to accommodate "transformative" work (which these models create)? Pretty much, yeah... If I take a bunch of copyright images and combine them into a new collage artwork, for example... where's the ethics on that? Being able to create transformative work is a fundamental and I would say foundational aspect of visual art. Without it human art and ai-art alike will suffer.
