In regards to whether or not selling fan art is legal that you asked people to contribute to, the easy and straight-forward answer is technically no. But it's a major grey area that is weighed against multiple different factors and usually dealt with on a case-by-case basis because the laws around it tend to also be against the SAME laws that protect artists' rights to their own original creations, and sadly, ai generated images at the moment too. A lot of major factors that are usually weighed are how transformative the piece is and whether or not it negatively reflects or alters the image of the original IPs brand/name in a derogatory sense or as a form of defamation and then it's taken further from there down a check-list. You can't sue people for using the color purple or having a character in a sun dress and there are a lot of loop holes like that that are designed specifically to protect artists/an individual's artistic expression in the medium they work in. Country matters a LOT too. Some countries don't give a flying pig so whether it's legal or not no one's going to come after a small artist selling a print or bat an eye. The doujinshi-scene which is entirely based off of fan works is extremely popular in Japan and most of the time fan arts of anime characters are much safer then ever touching big daddy Disney or Nintendo which will sue the floor out from under you if they sniff money coming your way for something they own instead of theirs. So a lot of fan artists stick to anime art. Selling a prints you made of batman in a samurai get-up should be safe-sailing based on its transformative nature alone and creative freedom but selling a fan art of batman rendered out to look like he does in the movie poster isn't. There's always been a don't ask-don't tell or what happens in vegas stays in vegas mentality around the sacred grounds of a convention hall though where artists show up with their fan arts in the place they can actually hopefully break even and get some new followers at best and a fan can get a sticker and that's that at the end of the day. In regards to the video though, even though I'm still processing how many AI generated images have won and almost won competitions now, it's going to take a while to process this new information too. I don't know why, maybe it was blind hope, but i wasn't expecting to ever see AI in a convention hall, so that's just really sad. What a stupid time to be alive and be an artist. I really hate it.
