Being conscious =/= being human. Conscious AI may have rights, but not at the same level as humans do. The ability to have free will, ability to discern between right and wrong, able to think why is it right/wrong. Being able to make either emotional or pragmatical decision, and choose between those two based on reasoning. These and many other traits are exclusive to the "human" species alone. The "mysteries" of human brain alone aren't fully understood by scientist yet, I sincerely doubt we can create AI that can fully replicate a human.
