The act of scraping copyrighted material is not inherently transformative, since it does nothing to the original work. Only the potential output could be considered transformative, but that is up to the end user and not under OpenAI's control.
To be compliant with fair use doctrine, OpenAI would need to monitor and terminate any account that is found to use copyrighted material in a non-transformative way, similar to how YouTube copyright-strikes its users and bans accounts. But that would be impossible for OpenAI to implement.
