"controversy" 1 is irrelevant (you could make the same argument about literally any tool that has been created after the dawn of capitalism and indeed the argument was made for most of them, the underlying issue is capitalism)
controversy 2 is it's undoubtedly theft:
- if I stole a tool from my neighbor used it and then put it back and then sold something I made with that tool I'm still guilty of theft even if what I stole wasn't part of what I sold
- but even more dammingly the ai models can spit out almost equal copies of some training data if you tweak the prompt enough that means within the model that work *is present* even if in a compressed and encrypted way
