Let’s look at it this way: Yeah, copyrighted work is being used to train. However, fair use is relatively easy to argue from a minimum threshold standpoint because generative AI is inherently transformative and doesn’t hurt the original content sales. That is to say, nobody is going to generative AI to read Harry Potter books. People are buying Harry Potter books at exactly the same rate as before. This scales to all the original books and media. The fan art that AI puts out is different than the original Harry Potter. That said, I don’t think copyright is necessarily the most interesting conversation. We can’t close this can of worms. China certainly doesn’t respect copyright law. All that happens if anything gets shut down in the US is these AI models continue to exist in China and the US economy crashes because we are 1000x leveraged into AI dominance. For that reason, the US simply won’t place meaningful limits on AI training data. Laws only mean so much at a certain point compared to the impact of enforcing them. No amount of intellectual debate does anything in the face of societal prosperity.
