The question that the jury will ultimately answer is not whether this is fair use buy rather do we want to surrender AI dominance to China. Because they are using every scrap of data they can get their hands on from around the entire globe to train their AI models. If we allow a legal precident to cock block our own AI development we might as well surrender to the inilevitable and start learning to speak Chinese.
There is no scenario where the global leader in AI somehow managed it by only using data it individually purchased the rights to from literally killions of individual sources.
NYT and everyone else AI uses data from still has the rights rolto profit from their work. They just dont have the right to prevent anyone else from learning from it which is by definition what AI is doing. Some humans have identical memories. Should their ability to perfectly remember every word in a single paragraph or even every word in an entire book be considered some sort of copyright violation? What if that person were employed as a teacher effectively reselling that they learned. Then should they be required to reach a purchad3 or licensing agreement for everything they remember? The very idea is ridiculous and the same standards apply to AI.
By the example given, even using prompt hacking they still.couldnt get a perfect replica of even a single paragraph. Still even if they could it would only prove that Arificial intelligence is just better at remembering what it leanrs than humans.
