Based on your description of the case, it seems the case was lost prior to the use of AI as it was untimely. I have to wonder if they took money from ChatGPT so the company could test AI in a real court case. In this manner, they would have to weigh a possible pay off against sanctions for a case that was unwinnable. So maybe yes, maybe no.
