Although we will have to accept that a non-zero malfunction rate is impossible, I think this unfortunate accident shows that some of these companies are extending beyond their technical capability. Isn't a difficult to see pedestrian crossing the exact type of scenario that we expect a modern autonomous vehicle would do better than a human? Even if not an infrared camera, those LIDARs should be able to detect a moving object.
