Sounds similar to sampling music. Taking parts and recreating. Also an AI is using a data in same way as humans do. As long as not making identical copy...So that's where the issue lies. Exact copies. Otherwise start the argument with hip hop sampling and go from there. Musicians have been ripped off for decades in similar fashion. Sampling continues to this day without compensation or permission. There needs to be guidelines but the truth is AI will be developed to skirt the line enough not to violate said guidelines. This is unfortunate. All that can be done is get people to see a difference between a creator and someone/thing who "samples" to create. Have to change the mind of the humans of earth and what they want. Honestly companies want quick facsimiles of things...not authenticity. Again music world has been through this for ages, from other humans. Not even AI. Sure that is on the way.
