To clarify, the issue with overfitting is something that can only happen with images that were uploaded many, many times into the dataset. It is a genuine problem, but it's not something that allows users to copy any random image in the dataset. Also, the larger datasets are based primarily on images from several years ago, and aren't frequently updated. The recent stories people have shared of people using AI to make a 1:1 copy of an artist's work were using img2img, meaning the user purposefully uploaded an image to make a new image based on it.
You say that "AI is able to take an image directly from a dataset and make a perfect replica"
1) You can only make a close replica with images that had many, many copies in the dataset
2) It's never a perfect replica
3) A lot of artists are also capable of making near-perfect replicas of existing works. Some painters and pencil illustrators make their entire careers around making near-perfect replicas of photographs
