The driver should have been paying attention to the road and bears responsibility in this, as does the cyclist. However, after several hours of sitting in the vehicle without incident its not hard to see how attention would fade. The frightening part of this is the massive failure of the technology to do its job. 1 - Vehicle is equipped with Lidar (or should be if used in full autonomous mode). Lidar needs no exterior lighting and sweeps 360 degrees around the vehicle many times per second. It should have picked up the cyclist as she left the far side of the road. The trajectory of the cyclist was directly across the road and the software should have reacted with a driver alert, warning, slowing the vehicle, etc. 2 - The left lane was clear, the vehicle could have simply changed lanes to avoid impact as it should have seen the danger long before the headlights illuminated her. There is clearly room for improvement and it's difficult to understand how so many system failures allowed this to happen.
