My best guess is that they would just shift the burden for all liability insurance on the car owner (or, technically, on the vehicle, with the insurance paid by the owner) instead of the driver - then it doesn't really matter if a non-person drives it. This is how it works in various countries outside the US already and for automated cars it would be IMO the most logical step since it wouldn't require any unusual arrangements.
