yes the human user isn't doing squat, the AI is the artist.
the human user in this case is just asking a artist to make art, like you would ask a human artist to make art.
the only difference here is one is AI and the other is human both have gathered and skilled by being inspired (looking at and training off of others work).
it's not like we don't already have copyright laws and fair use would still apply here....long as you ain't recreating copyrighted work and making profit off it, i don't see the issue.
